Industries are also categorized as Red, Orange, Green, and White based on their pollution potential, which determines the complexity and tenure of their license.

Who needs to obtain a Pollution Control License in India?

Any industry, factory, or business process that discharges effluents (sewage or trade waste) into water bodies, emits pollutants into the air, or handles hazardous waste must obtain a Pollution Control License. How can a business obtain a Pollution Control License in India?

A business must apply to their respective State Pollution Control Board (SPCB) through the online portal. The process generally involves:

  1. Submitting an online application with all required details.
  2. Uploading supporting documents (ID proof, address proof, site plan, project report, list of machinery, waste management plan, etc.).
  3. Paying the requisite government fees, which depend on the industry's category and investment.
  4. An SPCB official may conduct a physical inspection of the site.
  5. Upon successful verification, the 'Consent to Establish' or 'Consent to Operate' is granted.

Is it mandatory to renew a Pollution Control License in India?

Yes. The 'Consent to Operate' (CTO) is granted for a specific period (typically 1-5 years, depending on the industry's category - Red, Orange, or Green). It is mandatory to apply for renewal of the CTO before its expiry to continue operating legally. The 'Consent to Establish' (CTE) is a one-time license for setup and does not require renewal.
